TERMS OF USE
This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2011, and sets out the rules, regulations, Privacy Policy and Terms of Use for access to and use of our website and mobile application (collectively, the “Platform”) operated by Foodies Family Restaurant.
For the purposes of these Terms of Use, “You” / “User” means any natural or legal person who visits or uses the Platform to browse, order or interact with our services. “We” / “Us” / “Our” means Foodies Family Restaurant (the legal entity operating the Platform).
By accessing or using any part of the Platform you agree to be bound by these Terms of Use. If you do not agree to all the terms and conditions herein, you must not access or use the Platform.

SECTION 1 — GENERAL CONDITIONS
1.1 By using the Platform, You represent that you are at least 18 (eighteen) years of age and have the legal capacity to enter into binding agreements. If you allow minor dependents to use the Platform, you represent that you have the authority to permit such use.
1.2 You may not use the Platform for any unlawful or unauthorized purpose nor violate any applicable law or regulation. You must not transmit malicious code (viruses, worms, trojans, etc.). Any breach of these Terms may result in suspension or termination of your access to the Platform.
1.3 We reserve the right to refuse service, suspend or terminate accounts, or block access to the Platform at our discretion, including where we suspect misuse, fraud or violation of these Terms.
SECTION 2 — MODIFICATIONS TO THE SERVICE AND PRICES
2.1 Prices and availability of products, services and offers are subject to change without prior notice. We may modify or discontinue the Platform, or any part of it, at any time. We are not liable for any consequences of such changes.
SECTION 3 — PRODUCTS OR SERVICES
3.1 Certain products or services may be offered exclusively through the Platform and may be available in limited quantities. All product descriptions, images and prices are subject to change at our sole discretion.
3.2 We reserve the right to limit the sale of products or services to any person, geographic region or jurisdiction, and to cancel or refuse orders at our discretion.
SECTION 4 — ACCURACY OF BILLING AND ACCOUNT INFORMATION
4.1 You agree to provide accurate, current and complete purchase and account information. We reserve the right to refuse or cancel any order for reasons including incorrect pricing, unavailable inventory, suspected fraud or errors.
4.2 If we change or cancel an order, we will attempt to notify you using the contact details provided at the time of ordering.
SECTION 5 — OPTIONAL TOOLS
5.1 The Platform may provide access to third-party tools (payment gateways, delivery partners, analytics tools, etc.) over which we have no control. These tools are provided “as is” and “as available”.
5.2 Your use of any optional third-party tools is at your own risk and subject to the terms and privacy policies of those third parties.
SECTION 6 — THIRD-PARTY LINKS
6.1 The Platform may contain links to third-party websites, platforms or services that are not controlled by us. We make no representations about third-party content and accept no responsibility for the content or practices of third-party sites.
6.2 Any purchases, communications or interactions with third parties are solely between you and that third party. You should review their terms and policies before engaging.
SECTION 7 — PERSONAL INFORMATION
7.1 Our collection and use of Personal Information is governed by our Privacy Policy (available on the Platform). By using the Platform you consent to such collection and use as described in the Privacy Policy.
SECTION 8 — ERRORS, INACCURACIES AND OMISSIONS
8.1 Information on the Platform may occasionally contain typographical errors, inaccuracies or omissions (product descriptions, pricing, promotions, shipping estimates, etc.). We reserve the right to correct errors and update information at any time without prior notice.
SECTION 9 — PROPRIETARY RIGHTS
9.1 All materials on the Platform (names, logos, graphics, text, images, videos, software and other content) are protected by copyright, trademark and other intellectual property rights owned or licensed by Us.
9.2 Materials on the Platform are provided for limited, non-commercial, personal use only. You must not copy, reproduce, republish, download, post, transmit or distribute any material from the Platform without our prior written consent.
SECTION 10 — PROHIBITED USES
10.1 You are expressly prohibited from using the Platform for: unlawful purposes; transmitting harmful code; infringing intellectual property rights; harassing or discriminating against others; data scraping or automated data collection; or otherwise interfering with Platform security or operations.
10.2 We reserve the right to terminate or suspend any account that violates these prohibitions.
SECTION 11 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
11.1 The Platform, products and services are provided “as is” and “as available” without any warranties, express or implied. We do not warrant that the Platform will be uninterrupted, secure or error-free.
11.2 To the fullest extent permitted by law, Foodies Family Restaurant and its affiliates, officers, employees, agents and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue or data, arising out of or in connection with your use of the Platform.
SECTION 12 — INDEMNIFICATION
12.1 You agree to indemnify, defend and hold harmless Foodies Family Restaurant and its officers, directors, employees, agents and partners from any claims, liabilities, losses, damages and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your misuse of the Platform.
SECTION 13 — SEVERABILITY
13.1 If any provision of these Terms is found to be illegal, invalid or unenforceable, that provision will be severed and the remainder of the Terms will remain in full force and effect.
SECTION 14 — GOVERNING LAW
14.1 These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in Bangalore (Bengaluru), India.
SECTION 15 — CANCELLATION AND REFUND POLICY
15.1 Cancellation policies, refund eligibility and processing times may vary by product and offer. Unless otherwise specified on the Platform, cancellation requests must be made within the timeframe shown at checkout.
15.2 For complaints about orders, please contact our customer support at contact@foodiesonine.in. Refunds, credits or replacements will be provided at our discretion and in accordance with applicable consumer protection laws.
SECTION 16 — GENERAL
16.1 We may update these Terms at any time by posting the revised Terms on the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
16.2 For grievances arising from the use of the Platform, please contact the Grievance Officer (details below). We will acknowledge receipt and attempt to resolve complaints in a timely manner.
SECTION 17 — PROMOTIONS & PAYMENT OFFERS (PLACEHOLDER)
17.1 The Platform may offer promotional offers, cashback, credits or partner offers from time to time. Each promotion will have specific terms, eligibility criteria and validity periods. We will publish those specifics on the Platform and those specific terms will govern each promotion.
17.2 Any third-party payment promotions (e.g., EMI, partner cashback) are governed by the terms of the relevant third party. We are not responsible for third-party promotional fulfilment beyond facilitating the offer as specified.

SECTION 18 — VOTING, POLLS & USER PARTICIPATION
18.1 Where the Platform runs polls, contests or voting, such events will be subject to specific rules posted with each event. We reserve the right to disqualify entries or suspend polls where fraud or manipulation is suspected.
18.2 Decisions relating to winners, discounts or prize allocation are made at our sole discretion unless a specific rule states otherwise.
SECTION 19 — ACCOUNT DELETION
19.1 If you wish to delete your account and associated personal data, please email contact@foodiesonine.inwith the subject “Account Deletion Request”. We will process your request in accordance with applicable law and our Privacy Policy.
19.2 Upon deletion, we will remove your profile data from active systems, subject to any retention required for legal, tax or fraud-prevention purposes.
SECTION 20 — DATA SECURITY PRECAUTIONS
20.1 We implement reasonable administrative, technical and physical measures to protect personal information. Payment processing is carried out by PCI-compliant third-party providers and we do not store full card information on our servers.
20.2 Despite our safeguards, no transmission over the internet is 100% secure. We cannot guarantee absolute security of data transmitted to or from the Platform.
SECTION 21 — OPT-OUT
21.1 By creating an account or signing up for communications you may receive marketing messages by email or SMS. You can opt-out of promotional communications using the unsubscribe mechanism in such communications or by emailing contact@foodiesonine.in.
21.2 You may still receive transactional and service-related communications that are necessary for order fulfilment and legal notices.
SECTION 22 — COOKIES
22.1 We and our partners use cookies, pixels, web beacons, SDKs and similar technologies to authenticate users, remember preferences, analyze traffic, and serve and measure advertising. For more details, please refer to our Cookie Policy.
22.2 You can change your cookie preferences through your browser or device settings, but disabling cookies may affect the functionality of the Platform.
SECTION 23 — USES OF YOUR INFORMATION
23.1 We use collected information to provide, personalise and improve our products and services; to process transactions; to communicate with you; to detect and prevent fraud; to provide customer support; and to comply with legal obligations. For full details, please refer to our Privacy Policy.
23.2 We may anonymize and aggregate data for analytics and research. Aggregated/de-identified data may be used or disclosed without restriction.
SECTION 24 — YOUR CONSENT
24.1 By using the Platform you consent to the collection, transfer, storage, processing and disclosure of your personal information as described in these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.
SECTION 25 — POLICY CHANGES
25.1 We may occasionally update these Terms and our Privacy Policy. If we make material changes, we will endeavor to notify you by posting prominent notice on the Platform or via the contact details you supplied.
SECTION 26 — LINKS TO OTHER WEBSITES
26.1 The Platform may link to other websites. We are not responsible for third-party privacy practices or content and recommend that you review the policies of those sites before providing personal information.
